1. INTRODUCTION
This Privacy Policy (hereinafter referred to as the “Policy”) describes the main aspects of how JM TECHNOLOGIES LTD having its address at Valter Gkropious, 27, Office 106, Hercules Court, Limassol, Cyprus, 3076, a company that provides service to JustMarkets collects, uses and manages the personal information received from Users, via JustMarkets Trading application in connection with the provision of its services.

One of the company's main priorities is the full security of Users' information. The Company does not allow this information to become open to the general public or to be used by a third party. The Company does not provide, sell, disclose, or give Users' information and account details to third parties for temporary use. The company values its reputation and respects the Company's Users.

Once a User has created an account at the JustMarkets Trading application, additional information will be required to enable certain functions. Users will be asked to provide a copy of an identification document, such as government-issued identification documents, utility bill, and other documents as needed to comply with regulatory obligations, verify identity and residential address. 2. GATHERING THE INFORMATION
By opening an account, the User agrees to the collection and use of information in relation to this Policy and accepts all of the provisions set forth in this Policy. In order to open an account with the Company in the JustMarkets Trading application, the User must first complete and submit an application form to the Company by providing the required information, which includes: full name, date of birth, gender, country of residence, complete address, phone number, email, profession, employment status, government-issued identification documents, etc. This information is given by the User during the registration process through the Personal Area. Gathering information is an obligatory condition for the beginning of a business relationship with the Company. The information that Users provide to the Company may also be used by the Company to inform Users regarding the Company's services. JustMarkets Trading application collects, transmits, stores, and verifies personal data to enable secure and compliant financial services, including identity verification and transaction processing during account registration, money transfers, and service provision.

3. PERSONAL DATA THAT IS COLLECTED BY THE COMPANY
Personal data provided by Users includes:

  • Registration Information: Full name, date of birth, gender, country of residence, complete address, phone number, email, city code, tax identification number.
  • Verification Documents: Government-issued identification documents (passport, national ID, driver's licence, or similar documents) and documents that confirm the place of residence (utility bill – gas, water, electricity, or other), bank statement, or any government-issued document which can verify the client's address.
  • Transaction Information: Documents that confirm money transferring (in case of bank transfer, based on JustMarkets' decision).
  • Other Identifying Information: Any other information customarily used to identify the client, if legally required.

If the User decides not to provide some data from this list, we may not be able to provide you with some requested services.

4. THE USE OF INFORMATION
Information given by the User is used solely to provide quality services. For example, User's contact information may be used in case the Company needs to contact the User urgently or to inform the User about the Company's updates and news. By providing information about himself, the User verifies his Personal Area thus participating in bringing the AML policy to life. User's data is used to confirm the User’s identity, to open trading and/or partner accounts in the application, to quickly inform about new services of the Company, to maintain the database of customers' accounts, and to analyze statistical data for providing services and products of higher quality. Personal data given by the User can also be used for the following purposes:

  • verify the User's identity and conduct checks required by applicable laws and regulations, including “know your customer” (KYC), anti-money laundering, fraud, sanctions, and politically exposed person (PEP) checks;
  • performance of contractual obligations;
  • marketing purposes.

5. INFORMATION PROTECTION
The Company uses advanced technologies to provide the security of personal data. The Company has put in place appropriate security measures to prevent accidental loss, use, unauthorized access, modification or disclosure of personal data. The Company employees maintain the highest information security standards while processing personal information within the Company. The Company limits access to your personal data to those employees who require such access and only specific categories of employees have full access to personal data of Users (e.g. verification or account managers). Any information and access is encrypted using SSL technology. Where the Company has given to the User (or where the User has chosen) a password which enables the User to access certain parts of the application, the User is responsible for keeping this password confidential. The Company will not ask the User to share their password with anyone, including the Company’s employees. We do everything for the security of this data and collect only the information necessary for the functionality of the service.

6. RETENTION PERIOD
The retention period for personal data storage is seven (7) years. The Company has the right to delete all personal information, which was received from the User when it considers that personal information is no longer necessary for the purpose for which it was collected. The Company may keep personal data for longer than seven (7) years for legal, regulatory, or technical reasons.

7. DISCLOSURE OF INFORMATION TO THIRD PARTIES
The Company will not rent or sell information about the User to third parties outside the Company without the consent of the User. The Company may provide personal information of the User to third parties only under special circumstances. Such circumstances may be:

  • protection of personal rights and property in the court;
  • implementing the court orders;
  • providing information to law enforcement authorities at official request;
  • transferring of information to business partners, for example, to improve the quality of service, facilitate our service, to provide the service on our behalf, or assist us in analysing how our Service is used. In order to give the Users comprehensive, state-of-the-art high-quality service, the Company may exchange personal data with its business partners.

At the request of the User, the Company can provide information about the services that the partners provide for it. Users agree that we might disclose their personal information to third parties in the event that we sell or buy any business or assets, in which case personal data about our customers will be one of the transferred assets. In such cases, Users will be notified accordingly.

8. CHANGES IN PERSONAL INFORMATION
Because the Company assumes that all the information is full and relevant, the Company asks the User to notify the Company of any changes in the personal data via the appropriate forms of the Personal Area.

9. RIGHTS OF THE CLIENT
Every User has the next rights regarding the processes of collecting, using, and managing his/her personal information:
a) the right to be informed and the right to access;
The Company describes the procedure of processing of personal data in this Policy. In case Users have any inquiries regarding this Policy or their rights, or they need additional information, they could email us at [email protected].

b) the right to rectification;
Users may inform the Company at any time that their personal details have changed or that there is wrong data about them in the Company by sending an email to [email protected].

c) the right to restrict processing;
Users can ask us to restrict the processing of their personal data in certain circumstances such as if they contest the accuracy of that personal information or object to us processing it.

d) the right to data portability;
Users have the right to obtain personal information that they have provided us with and to re-use it elsewhere or ask us to transfer this to a third party of their choice.

e)the right to object;
Users can ask us to stop processing their personal information in certain circumstances. Also, if they receive emails from us, they can always opt-out at the bottom of the emails which Users receive from us, or by contacting us.

f) the right to erasure;
Users can ask us to delete or remove their personal information in certain circumstances such as if we no longer need it or they withdraw their consent provided that we have no legal obligation to retain that data. Such requests will be subject to any retention limits, which we are required to comply with in accordance with applicable laws and regulations. If Users want to delete an account in the application, they must write a request to delete said account to [email protected] All user data that is associated with the application account will be deleted unless the Company must retain the information for legitimate reasons, like security, fraud prevention, or regulatory compliance.

g) the right to refusal.
The User has the right to refuse to provide the personal information required by the regulations if it goes against the User's beliefs. However, in this case, the Company would not be able to provide the User with its services.

If Users do not want us to use their personal data, they must inform the Company by sending an email to [email protected]. The Company will not be able to continue to provide services and information requested by the User if the User makes such a decision.

10. UPDATES TO THIS POLICY
From time to time the Company has the right to update this Policy to ensure that any new services, requirements, and technologies, as well as any changes to our business operations, are taken into consideration, as well as any changes to legislation. In case of any updates to this Policy, the Company will post those changes to this Policy and inform Users via the company website and/or by sending an email.

11. CHILDREN`S PRIVACY
JustMarkets Trading application cannot be used by anyone under the age of 18.
